We are announcing our Ministry of Justice integration, allowing eligible DEIS users to search court records with full IPP3A compliance.
What is available?
The integration provides access to:
- Civil court judgments
- Criminal conviction records (where publicly available)
- Insolvency records
- Court orders
Eligibility
Access to Ministry of Justice records through DEIS requires:
- A valid reason for the search (e.g., employment screening, credit assessment, due diligence).
- Compliance with the Criminal Records (Clean Slate) Act 2004.
- Acceptance of Ministry of Justice terms of use.
Clean Slate Act
The Clean Slate Act allows eligible individuals to conceal their criminal record after a rehabilitation period. DEIS respects Clean Slate provisions — searches will not return information that is protected under the Act.
IPP3A for court records
Court records present an interesting IPP3A question. While many court records are publicly available, the OPC has indicated that accessing them in bulk or through an aggregation service (like DEIS) may warrant notification even if the individual records are publicly accessible.
DEIS requires an IPP3A pathway selection for every court record search, ensuring your compliance is documented regardless of how the publicly available exception is interpreted.
