Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the Deis platform, website, and services (collectively, the “Service”) operated by Forman Pacific, LLC (“Deis”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Definitions
“Business User” means any individual or entity that creates a Deis account to run lookups on third-party data sources for business compliance purposes.
“Requestor” means any individual who uses the Service to exercise their rights under the Privacy Act 2020 by authorising Deis to make information access requests on their behalf.
“Agency” means any organisation (government department, private company, or other entity) that holds personal information about a Requestor.
“Lookup” means any search or query performed through the Service on a connected data source.
“Data Source” means any third-party service connected to Deis, including but not limited to Carjam, PPSR, Companies Office, NZBN, Centrix, Equifax, illion, Landonline, and Ministry of Justice records.
Part A
Business Users
3. Business User obligations
As a Business User, you agree to:
- Use the Service only for lawful purposes and in compliance with the Privacy Act 2020 and all applicable New Zealand legislation.
- Select the correct IPP 3A compliance pathway for each lookup and provide accurate justification.
- Not use the Service to harass, stalk, or unlawfully monitor any individual.
- Maintain the confidentiality of your account credentials and magic-link access.
- Ensure that all team members added to your account understand and comply with these Terms.
- Not resell, sublicense, or redistribute lookup results or access to the Service.
4. Business fees and payment
Creating a Deis account is free. The annual subscription is $99 NZD, billed annually. Enterprise pricing is negotiated individually.
Per-lookup fees for premium data sources are charged monthly in arrears. Current per-lookup pricing is published on our pricing page and may be updated with 30 days’ notice.
All prices are in New Zealand dollars and are exclusive of GST where applicable.
Part B
Requestors (Individuals)
5. Agency and authorisation
When you submit a data request through Deis, you authorise Forman Pacific, LLC to act as your authorised representative to make an information access request under Information Privacy Principle 6 of the Privacy Act 2020 on your behalf.
This authorisation constitutes your written authority for Deis to act as your agent. You may revoke this authorisation at any time by contacting us. You retain the right to make IPP 6 requests directly to any agency at any time without using Deis.
6. Making a request (free)
Making an information access request through Deis is free. There is no charge to submit the formal request or to view a summary of data categories (headers) held about you once the agency responds.
Agencies are required to respond within 20 working days (s 44(1) of the Privacy Act 2020). Public sector agencies generally cannot charge you for access to your own personal information. Private sector agencies may charge a reasonable fee under s 66 of the Privacy Act 2020 — any such fee is between you and the agency, not Deis.
7. Extended data access (paid)
Deis offers optional premium services for Requestors who wish to access the full records, AI-powered summaries, file downloads, data correction tools, and ongoing monitoring for $19 NZD per year (12 months of unlimited access across your inbox, renewing annually unless cancelled). These are value-added services provided by Deis, not charges for the underlying personal information itself (which you are entitled to receive from the agency directly under the Privacy Act 2020).
Before you make any payment, the applicable fee will be clearly displayed. You are under no obligation to use these premium services. You can always request your data directly from the agency at no cost (public sector) or reasonable cost (private sector).
Current fees for extended data access are displayed at the point of purchase. All prices are in New Zealand dollars and include GST where applicable.
8. Your rights under the Privacy Act 2020
- Right to be informed (IPP 3A) — when an organisation collects your personal information from a third party, they must take reasonable steps to let you know.
- Right of access (IPP 6) — you can request access to any personal information an organisation holds about you. They must respond within 20 working days.
- Right of correction (IPP 7) — if your information is inaccurate, you can ask the organisation to correct it.
- Right to complain — you may complain to the Office of the Privacy Commissioner at privacy.org.nz if you believe your privacy rights have been breached.
- Right to act directly — nothing in these Terms limits your ability to exercise your Privacy Act rights directly with any agency, without using Deis.
9. Data handling and storage
Data collected and received through the Service is stored securely. We process personal information in accordance with the Privacy Act 2020 and our Privacy Policy.
Evidence log entries are retained for 7 years by default. Lookup results and Requestor data are retained according to the applicable retention policy, which complies with the Privacy Act 2020. You may request deletion of your data at any time.
10. Limitation of liability
Deis facilitates access to third-party data sources and agencies. We do not guarantee the accuracy, completeness, or currency of data returned by third-party sources or agencies.
To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 where applicable), our total liability to you for any claim arising from these Terms or the Service is limited to the fees you paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits any rights you have under the Consumer Guarantees Act 1993 that cannot be excluded by law.
11. Fair Trading Act compliance
In accordance with the Fair Trading Act 1986, all pricing is transparent. No fees are charged without clear disclosure. The initial data request is free. Any charges for premium services are displayed before payment is taken. We do not engage in drip pricing, hidden fees, or misleading representations about pricing.
12. Termination
You may close your account or revoke your authorisation at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.
On termination, your data remains available for export for 90 days. After that period, it is deleted in accordance with our data retention policy unless you request earlier deletion.
13. Governing law
These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or the Service will be resolved in the courts of New Zealand.
